            Agreement: By downloading, installing, or using LunaLull, you agree to be bound by these
            Terms of Use. If you do not agree to these terms, please do not use the App.
        

1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the LunaLull mobile application ("App") provided by LunaLull ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

LunaLull is a mobile application designed to help users relax, focus, and sleep better through:

Ambient sounds and soundscapes
Customizable sound mixing
Sleep timers and fade-out features
Background playback capabilities

3. Eligibility

You must be at least 13 years of age to use this App. By using the App, you represent and warrant that you meet this eligibility requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

4. User Account and Access

The App does not require account creation. Your app preferences and saved mixes are stored locally on your device. You are responsible for maintaining the security of your device.

5. Subscriptions and Payments

5.1 Free Trial

We may offer a free trial period for new users. At the end of the trial, you will need to subscribe to continue accessing premium features.

5.2 Subscription Plans

LunaLull offers the following subscription options:

Monthly Subscription: Billed monthly
Yearly Subscription: Billed annually at a discounted rate

5.3 Billing and Renewal

Payment will be charged to your Apple ID account at confirmation of purchase.
Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage and cancel your subscriptions by going to your App Store account settings after purchase.
Any unused portion of a free trial period will be forfeited when you purchase a subscription.

5.4 Refunds

All purchases are processed through the Apple App Store. Refund requests must be made through Apple according to their refund policy.

6. Acceptable Use

You agree not to:

Use the App for any unlawful purpose
Attempt to reverse engineer, decompile, or disassemble the App
Copy, modify, or distribute the App's content without authorization
Use the App while driving or operating heavy machinery
Interfere with or disrupt the App's functionality
Use the App to infringe on any third party's rights

7. Intellectual Property

The App, including all content, features, and functionality (including but not limited to all sounds, music, text, graphics, logos, icons, and software), is owned by LunaLull and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. Health Disclaimer

Important: LunaLull is designed for relaxation and sleep improvement purposes only. The App is not intended to diagnose, treat, cure, or prevent any disease or health condition. If you have a sleep disorder or other health concern, please consult a qualified healthcare professional.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The App will be uninterrupted, secure, or error-free
Any defects will be corrected
The App will meet your specific requirements
Results from using the App will be accurate or reliable

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LUNALULL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your use or inability to use the App
Any unauthorized access to or use of our servers
Any interruption or cessation of transmission to or from the App
Any bugs, viruses, or the like that may be transmitted through the App

11. Indemnification

You agree to indemnify and hold harmless LunaLull and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the App or violation of these Terms.

12. Modifications to the App

We reserve the right to modify, suspend, or discontinue the App (in whole or in part) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App.

13. Changes to Terms

We reserve the right to update or modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

14. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which LunaLull operates, without regard to its conflict of law provisions.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and LunaLull regarding the use of the App and supersede any prior agreements.
